Federal Question Cases
These cases involve the U.S. Government, the U.S. Constitution or other federal laws. This page is meant to be a resource for people caught up in the federal criminal justice system. It contains answers to general questions about how federal criminal cases work. To use the language of lawyers, it contains links to information about federal criminal procedure.
This page only deals with things that happen from when a person is charged with a crime in federal court until they're convicted. There are three steps to a federal criminal case. This page contains an overview, and there are links that have more information about specific parts of a case. -
Pretrial
During this part of the case, a person is charged, whether they'll be in jail or released (and, if released, on what conditions), the Assistant United States Attorney will have to provide evidence about the case, and pretrial motions about whether the case should be dismissed or some evidence should be thrown out will be filed.
Trial or Plea
During this stage, one of three things will happen. In the majority of federal criminal cases, a person will plead guilty. Here's a video about how we think about whether a person should plead guilty or go to trial. If a person accused of a federal crime pleads guilty, the case goes to sentencing (sometimes people want to try to withdraw the plea before sentencing - here's a video on how that works).
If the person decides not to take a plea, the case goes to trial. If the jury says the person was not guilty, then the case is over and the the person goes on with their life. If the jury says the person was guilty, though, the case then goes to sentencing.
And, finally, in some rare cases a defense lawyer can talk a prosecutor into dismissing the case.

3ºThe people committing these crimes aren’t registered gun owners folks. They are people who have no value for human life that can pull a gun out on a whim and shoot it randomly or on purpose at anyone at any time. That is not a gun problem. That’s a people problem. I’m sure most of these murderers aren’t registered gun owners. They are thugs. We’ve raised a society of people who have no regard for human life and until that changes, the rest won’t change. Prayers to this family (and all the others) who have lost loved ones to senseless acts of violence.
4ºVery sad but no more gun laws would not have stopped this. Enforcing current gun laws is what would stop this. It should be a min 10 years for any felon caught with a gun because they never do the full sentence anyway. Anyone who is in a gang should be put in a national database and not be allowed to own any firearm until they can prove they are no longer in a gang. Anyone who associates with a gang is part of the gang. And almost every shooting in ever major city is gang related and the guns are not obtained legally. In a perfect world we could just lock every gang banger up for good but that will never happen.
5ºThanks to liberal democrats that run these cities and states you get what you get. Maybe people will learn to stop putting democrats in charge of their safety. All they did last year was cry to defund the police, they all cut funding in these democrat ran states to crime task forces, they call to prosecute cops for killing criminals, they make no bail laws to let these thugs right back out on the streets. VP Harris set up a bail program last year to help get rioters right back out of jail. She called for defunding the police that protect INNOCENT people yet surrounded herself with taxpayers funded security and military. They freely allow illegals and illegal weapons to come across our southern border. Cops cannot do their job because a democrat wil try and prosecute them for something. So don’t cry about ur kids being killed in these states you elected democrats to run.
6ºDemocrats not only want to defund the police but they want to defund the border.
"House Democrats proposed a new spending bill that would cut funding to immigration enforcement agencies and rescind funds allocated to the border wall.
The bill, which makes appropriations for the Department of Homeland Security (DHS), allocates $14.1 billion in net funding to Customs and Border Protection (CBP), $927 million less than the previous year’s budget, according to a press release from the House Committee on Appropriations. The bill also rescinds $2.1 billion in funds from last year intended to go towards the border wall, and provides Immigration and Customs Enforcement (ICE) with $1.55 million less than the previous fiscal year.
The bill also provides no additional funding for Border Patrol agents."
