Geico ordered to pay Missouri woman $5.2M after she contracted STD in a car

She contracted a sexually transmitted disease from her partner in his vehicle, which was insured by the company.

Kristin Mooney and Keri Grimaldi no, they say 80% will have it in their lifetime at some point. That’s not the same as WHO HAS IT EIFHR NOW.

His claim was that 80% HAVE IT NOW which is NOT TRUE, no matter who wants it to be.

Also, the studies are referring to the US population, not GLOBAL population in either category, sexually active or in general.

To say MOST PEOPLE, that includes every LIVING HUMAN right now. You can’t switch it up and apply it to ANY OTHER DEFINITION.

For example, I can’t say MOST PEOPLE have been to NYC just because a study says 95% of ADULT MALES IN THE USA WILL GO TO NYC AT SOME POINT IN THEIR LIVES. I could ONLY say “MOST ADULT MALES IN THE USA WILL GO TO NYC AT SOME POINT IN THEIR LIVES”.

Stop picking things out of studies and just applying them to a claim just because 80 is MOST OF SOMETHING, that doesn’t mean it applies to just any claim. MOST PEOPLE = the majority of all the people alive on earth right now. And NO, most of all of the people alive on earth right now do not have HPV, nor is there a study that claims they do.

Bottom line. Don’t be mad at me because that’s a fact. Just stop making up claims and lies to force your points you want so bad to be true but aren’t.

Dr. Elias Munshya study the case and probably you can air it on bakwetu tv with some lawyers how it played out. According to the full story on CNN with my lay man understanding the woman made an offer directly to GEICO company for compansation of damages since should contracted HPV in the car from partner of 1million,then GEICO refused to pay in 2021 and she took them to the court of arbitration and after appealing she was awarded 5.2million. my question I have Mr Munshya is that Didn't these two people plan just to defraud the company the money maybe it has not been a good insurance company.

If you read the article GEICO lost because they denied coverage and pretty much ignored the case and didn't offer a defense to protect their insured. Which is a violation of good faith and now the man that gave the women an STD can sue GEICO for not defending him. Little do people know, like CNN, your insurance only has to pony up what you have I'm coverage. So if this dude only has 30k in coverage then that's all GEICO has to pay on behalf of their insured and then the insured has to pay the rest, so this dude now owes 5 million to the girl he "injured in his vehicle"

Marge Ellefson Geico should have defended the man in order to protect their own interests. Instead, they chose to ignore the lawsuit. That is likely the reason why the settlement was so high. If they had acknowledged the lawsuit then they could have more than likely paid out a lot less and then adjusted their terms to exclude these types of claims (if at all possible by law). The article makes it seem like the settlement was paid through the car insurance policy (because it happened in his car) but I don't see how this would be possible since the limits on those policies are not that high. I'm assuming the settlement was paid out based on the insured's umbrella policy.

This is ridiculous, many people don’t seem to have comprehensive sexuality education and it shows in this case. You cannot test men for HPV. It is impossible to know if a man has HPV unless warts, which are caused by HPV, express themselves physically meaning they start growing on his groin/ genitalia region. After which Then the only way to know if it is HPV is if a doctor takes a biopsy sample and sends it to a pathologist to examine under a microscope. Women are different, they can have their cervixes swabbed and those samples can be tested for HPV. Unless he had a diagnosis from before which would mean he had warts removed, and didn’t tell her then yeah he gave her HPV. Otherwise she’s the 1 in 2 people who get it before turning 50. Hoe.

Azalee Me too! Let's entertain this foolishness for a minute. Another news media reported that there were several encounters. For one, how can she determine which encounter gave her the virus? It could have been acquired in a bedroom! Next thing, auto insurance is not meant to cover personal liability. That comes from the property policy and/or a PLUP if they have one. So how in Moses knuckles can this woman claim that the auto insurer is liable for something she knowingly agreed to do knowing the risks? Also, why such a large judgement? She has not gotten cancer as yet which HPV causes and apparently most people clear the virus with no longstanding effects. So the award seems high unless they awarded her punitive damages? I hope Geico appeals. This sets a bad precedent! Also, most policies have a communicable/transmittable disease exclusion. This is rubbish!

So please don't come at me... coming from insurance for 18 years, I'm more surprised there wasn't an exclusion for employees using company vehicles on personal times. Although, was she a customer? I'm being more comical because that AFTER reading the article and the amount of damages she was suing for and whatever claims rep chose to deny the case without properly investigating policy language thinking it was asinine and a slam dunk closed claim there was a potential for loss based on THEIR policy and language and/or exclusions or lack thereof. I'd imagine a claim lawsuit that size would have been investigated more thoroughly to prevent if possible a settlement of this nature.

DeAnna Bryant “It’s not important to test for it unless you are exhibiting cervical changes”. I understand that this may be a recommendation but recommendations also tell women they don’t need to be screened for ovarian cancer unless it runs in their family. Next thing you know they’re diagnosed at Stage 3 or 4. So I don’t always agree with the “recommendations”. I started in GYN back in 2004 and over the years, I’ve seen HPV more than anything else. Yes, the body can clear it on its own but it never has a chance to clear if a person keeps getting reinfected… whether it’s by the same partner or a different one. I’m big on advocating for yourself and asking for tests even when your provider feel like you don’t need it. According to the CDC, there are 13 strands that cause cervical cancer. Well, those 13 strands could be the most commonly spread strands of HPV. We cannot minimize how common HPV is. It is estimated that every sexually active person has been or will be exposed at some point.

I have SO many questions! First, everyone knows geckos can't pass HPV to humans. Know who can pass HPV to humans?? Humans! I bet Jake and Flo tipped that lady off because her boyfriend was probably caught up in an insurance triangle with them in the past, and poor Martin was their scapegecko?! After all, Jake does have a history of soliciting, and you know Flo is shifty. Think about it... can you ever really trust a guy that only wears khakis?? Or a woman that for sure is wearing a bump it AND a headband?? Also, if Don Draper (Jon Hamm) is hitting up Flo, you know she's promiscuous! This mystery just doesn't add up. #justiceformartin

10ºLol it’s clear no one read the article just the headline. Geico didn’t do ANYTHING which is what the problem was; just denied the claim. She asserted Geico was liable because the policy allegedly provided coverage. It probably didn’t, but Geico took the position that it wasn’t going to defend the insured or put a defense on that it wasn’t liable or that the policy did not cover it. An arbitrator decided that the policy should cover it. The reason Geico lost this case was because when they appealed the court said that it could have raised defenses during the trial phase but didn’t and now it was bound by arbitrators award.
