I agree in this case that there was overreaction, especially bc he was never asked to leave by the bank and he offered to do so. HOWEVER, Freedom of the Press is not absolute. If the police are attempting to stop a violent situation and reporter gets in their way, they should not be protected since they are placing themselves and other in danger. Another issue I have with the First Amendment is how the press can rush to press to try to scoop other outlets and get a headline or front page story and if it turns out they were wrong, the retraction gets buried. Any retraction where the press was wrong should be required to receive the same level of coverage as the incorrect story bc we are talking about people's live and livelihoods!!!

So he is on a public right of way (sidewalk) talking to people/engaging them in conversation. THAT IS PERFECTLY LEGAL. Even more disturbing is that the person who recorded the detention was apparently threatened with arrest. If that person was not interfering with the officer’s duty (stop recording/move back X (unreasonable) feet), then that person had EVERY RIGHT to record the officer’s actions. Any cop who behaves in that manner SHOULD be punished, up to and including 18 USC 241/242 (deprivation of rights/conspiracy to deprive rights under color of law).
Cops DO have a tough job, and they put up with a lot of , but they do NOT have the right to curtail/abuse the rights of otherwise lawful behavior by law abiding citizens

JP Morgan Chase is the people that Kanye was pointing out… That’s a brother that’s in the back of that police car… It was racially motivated… remember they removed $100 million of Kanye West money, and they kept Jeffrey Epstein’s money and Harvey Weinstein’s money in there… banks, don’t turn down money they’re in the business of making interest off your money??? they kept molesters and pedophiles money in their bank and was mad and Kanye West for some strange reason just because he exposed the truth about them, … Always know who they really are… imposters… and they are exposed

Annette Sanders-Troutman …don’t confuse recording police activity with interference.
Interference is when a person’s actions require the officer to stop what they are doing or to divide their attention to deal with disruption of what they are doing.
For example, if you get in the way and physically impede what they are doing….or you are not moving to cover during a shooting (requiring the cop to try to address YOUR safety) you are likely interfering.
The simple act of staying out of the way and recording or even coming to the aid of an arrestee against whom obvious unnecessary/excessive force is being used is NOT interfering

The red arrow is where the journalist was. What part of this looks like public property?

And here’s the latest response from the Phoenix Police Department:

“The Phoenix Police Department received a letter from the Editor in Chief of the Wall Street Journal expressing concerns about an interaction with one of their reporters and a Phoenix police officer. This letter was shared with our Professional Standard Bureau for review and they are conducting an administrative investigation. Once the administrative investigation is complete, it will be made available as part of a public records request. Bank personnel contacted police after they received customer complaints that a man was approaching people as they entered the bank asking them personal questions. The interaction between the officer and the man who was the subject of the complaint took place on private property.”

Jason Barker so in your world...if I happened to knock on the door at your house, to let you know you left your car door open, you can have me thrown in jail for trespassing?

The reporter said he was never told he was trespassing. According to what we KNOW, the bank employees have never maintained that they did ask him to leave.

Let's use common sense, shall we?

BTW, in many states laws require a warning that you aren't allowed to be on property before you can be convicted for trespassing on the property. While a property owner can directly tell a trespasser to leave the premises, in many states, there are other ways to provide notice that property is off limits.

Isaac Fast Oh that’s simple. Why weren’t any bank employees arrested then?

The journalist was on private property standing near the front door of a bank asking people questions about bank accounts as they walked up to the entrance. He chose to dress down so people didn’t think he was a salesman but also didn’t want anyone to know he was a journalist so he could get casual replies. At what point does this seem appropriate to you? Do you want a stranger approaching you in front of a bank asking you questions?

Soon after, two bank employees ask what he is doing and he states he’s a “journalist”. He THOUGHT he was on public property. Only he and the two employees know how that conversation went and they chose to go back inside and call the police. It is 100% their right to call the police on someone that is on private property. Could they give notice? Yes. Do they have to? Absolutely not. Anyone that thinks otherwise is delusional and gets their case law from a cereal box.
