Again, Bihar is facing a major crisis or someone may say Jangle Raj part-2. I wanted to just explain the situation of Bihar with help of one case from a village near to Nepal border.
Khata no-811, Kheshra no-2300 is old pond land privately owned by multiple people from Mouza Manpour, Benipatti, Madhubani, Bihar. This kheshra no was not removed from Shairats list post court order on 9th July 2008 case no-CWJC no-12728 of 2005 by Patna high court. Local district administration had not only avoided removing this Kheshra no from Shairats list but issued a contract for Fish farming to 3rd party and local administration not stopped there, they also issued a big contract for beautification of this pond that too within 3-6 months’ time. You can imagine Bihar is struggling for employment, the right environment, and social justice to survive common people. In such a situation govt. officials and local authorities are taking such a biased fast decision to acquire local people's lands and ponds and not supporting mass/common people. This pond is belonging to ~50+ owners from all the castes and people of this village. First, No one can claim this is social justice, second, this village people stayed together and always stayed in peace since long time if the external intervention was not introduced third, this area is near to Nepal border and any confrontation may lead to big concern.
Now need to understand about this pond land was belong to all private owners and an order issued by DCLR way back in 1974 under section 4h instructing local authority not to re-open this case as they were serious encroachment and abridgment of petitioners, rights including article-14 and 300A of the constitution of India. Such instruction into rights of citizens cannot be countenanced in any civilized society.
Introducing external contractors for fish farming that too with speed decisions which never happens in past by any govt. authority and it may lead to a shift of this contract to border-crossed illegal migrants as contractors which they are waiting for. This village is near to Nepal border and controlling law and order near the border area is very difficult my only submission is if villagers are living together with peace and harmony, please don’t change and induct external interference to create tvurbulence in this area.
