• Try Your Case in the Courtroom, not the Media. Rule 3.6 (“Trial
Publicity”) is long and complex, and is perhaps the ethical rule most
likely to trip up the unwary prosecutor. The public’s intense interest in crimes committed in their communities, which is reflected in media attention, combined with the propensity of some defense attorneys to try their cases in the press, may tempt you to provide the media with more information than you should. The general rule is that a lawyer participating in a criminal or civil proceeding “shall not make an extrajudicial statement that the lawyer knows or reasonably should know will be disseminated by means of public communication and will have a substantial likelihood of materially prejudicing an adjudicative proceeding in the matter” (Rule 3.6[a]). Rule 3.6[a] includes a list of categories of statements to the media deemed likely to materially prejudice a criminal proceeding, and a list of statements that can properly be made; read it before speaking with the media. Any statement announcing that a particular person has been charged with a crime must be accompanied by a statement that the charge is merely an accusation and that the defendant is presumed innocent unless and until proven guilty (Rule 3.6).


Is Trump guilty?

The indictment was sealed, which means specific charges are not publicly known. The grand jury, composed of 23 members of the public, simply hears evidence. At the end of that process, prosecutors decide whether to ask the jurors to vote on an indictment, by majority vote. The case here is believed to involve a hush money payment made to Stormy Daniels by Trump’s lawyer, Michael Cohen, to keep her from publicly discussing an affair she had with Trump prior to the 2016 presidential election.

In a 2018 CBS 60 minute interview, Stormy said she was risking a million-dollar fine by speaking on national television, saying “it was very important to me to be able to defend myself.” Before the interview, Michael Cohen threatened her with a $20 million lawsuit, arguing that she had broken their non-disclosure deal, what she calls a “hush agreement.”

A grand jury simply investigates whether there is enough evidence to pursue a prosecution. Yesterday, the jury voted to bring criminal charges.
Trump claims that payments under a NDA are legal. NDAs are routine agreements to prevent employees who leave their office from besmirching the reputation of the company or their managers. The burden is on Stormy to prove that the sensitive information is not confidential, which is difficult and time-consuming. The default standard of proof, preponderance of the evidence, that is, evidence that is more likely than not, is the standard.

It is not illegal to pay someone compensation in exchange for a nondisclosure agreement (NDA). Since the payment was made a month before the presidential election, critics argued that the money could amount to a campaign violation. In August 2018, Cohen pleaded guilty to tax-evasion and breaking campaign finance rules. Cohen testified under oath that Trump had directed him to make the $130,000 payment before the 2016 election and that Trump reimbursed him for the payment. Federal prosecutors say the hush money payments amounted to illegal, unreported assistance to Trump’s campaign but declined to file charges against Trump himself.

An NDA can be declared null and void if the language is unduly broad, irrational or onerous. NDAs that are overly broad, oppressive or attempt to contain non-confidential information can also be challenged. The NDA here fails to meet that test. An NDA may also be declared void in some states if it involves disclosure of sexual assault or harassment.

Many experts believe that a complete ban on NDAs as part of settlement agreements would not eradicate sexual harassment nor as they always in the best interest of women. Many women wish to preserve their privacy and keep the details of trauma and mistreatment they have endured confidential.

In November of 2022, Congress passed a law (the Speak Out Act) preventing employers from forcing victims of sexual harassment to remain quiet. The Law began in response to revelations that Harvey Weinstein, Roger Ailes, Bill O’Reilly and Michael Bloomberg used NDAs to keep quiet the sexual misconduct claims against them. The law prevents courts from enforcing NDAs in “disputes” where a party alleges sexual assault or harassment. Congress does not define “disputes” so it is unclear whether Congress is referring to formal litigation or simply an informal internal complaint. The law does not prevent employers from entering into NDAs to settle an assault or harassment claim. In the instant case, it appears that Trump will be vindicated as long as the payment is not considered an illegal campaign contribution, a far-fetched allegation.

Some experts believe that Trump could be charged with falsifying business records, which can be a misdemeanor or a felony under New York law. To secure a conviction on a felony charge, prosecutors would have to prove that records were falsified with the intention of committing or concealing a second crime, which is extremely unlikely in this case. Charging Trump with falsifying business records is unlikely since the hush money here has no relation to any business.

Trump’s attorney, Mr. Tacopina, claims that personal funds used to squelch false, but embarrassing statements, in an NDA are legal. Furthermore, Mr. Tacopina states that such payments “are not a campaign finance violation, not by any stretch.”

Many Republican officials have leaped to Trump’s defense. Ronna McDaniel, the chairman of the Republican Party called the indictment “a blatant abuse of power from a DA focused on political vengeance, instead of the people’s safety. Mike Pence called the idea of indicting a former president for an NDA “deeply troubling.” Gov. Chris Sununu said Trump is being unfairly attacked.


How can President Trump avoid prosecution in New York?

He has many options.
