A law passed 150 years ago that banned the mailing of contraceptives, lewd materials and drugs that induce abortions could provide a pathway for effectively banning abortion nationwide – even in states where the procedure is legal

First, there are multiple laws that have existed throughout U.S. history against the mailing of contraceptives and obscene materials, not just one law. Second, the law prohibiting the mailing of abortion-inducing drugs was not passed 150 years ago, but rather in 2000 with the passage of The Drug Importation Prohibition Act, which prohibits people from purchasing drugs from abroad that are not approved by the FDA, including some drugs used for abortion. In addition, abortion is legal in the United States, and there is no national law prohibiting abortion. The extent to which abortion is regulated and restricted varies from state to state, but the U.S. Supreme Court ruled in 1973 in Roe v. Wade that a woman has the right to choose abortion in certain circumstances, including during the first trimester of pregnancy
