Marco Rubio calls on Barr to investigate John Kerry


after it was revealed that Kerry had been in secret talks with the Iranian government in a bid to salvage the Iran nuclear deal

Without that phrase, Kerry might have an argument he didn't technically violate the Logan Act. But, the second he discusses the nuclear deal and offers ANY advice to Iran about what to do about it, he is guilty. The text of the Logan Act is quite clear on the matter.

§ 953. Private correspondence with foreign governments.

Any citizen of the United States, wherever he may be, who, without authority of the United States, directly or indirectly commences or carries on any correspondence or intercourse with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government or of any officer or agent thereof, in relation to any disputes or controversies with the United States, or to defeat the measures of the United States, shall be fined under this title or imprisoned not more than three years, or both.

Kerry is a private citizen, who did not have the authority of the United States, who directly carried on, by his own admission, talks with agents of the Iranian government on an issue related to a dispute Iran has with the United States. There is no argument here.
